    yes there are conditions ! and the most important is that "Don't sell themes which are not created by you (Or you don't have rights to sell)" like themes created by other big sites "Studiopress" There is a special terms and condition to sell a theme? hope this solves your problem

    yes.. you should create your own them before selling.do not copy another theme.
